Our General Terms and Conditions
Article 1 – Identification of the Seller and Consumer Status
The “Seller” of the items in this webshop is Proper Plates B.V., located at [Your Address, e.g., Amsterdam, Netherlands], Chamber of Commerce (KVK) number [Your KVK Number]. You can reach us via sayhello@eatproperplates.com.
The “Customer” is the individual placing an order via www.eatproperplates.com (hereinafter: the “Website”). By placing an order, the Customer declares to be acting as a consumer (private use) and not for professional or commercial purposes. If you wish to purchase Proper Plates for commercial use (e.g., Deli partnership or Office Lunch service), please contact our sales department at sayhello@eatproperplates.com. The Customer also declares to be 18 years of age or older.
Article 2 – Applicability
These General Terms and Conditions (the "Terms") apply to all online offers and sales of items from the Seller's range to consumers via the Website at the time the order is placed. The Seller currently delivers only to addresses domiciled in the Netherlands.
Article 3 – Prices
All prices listed on the Website include VAT (BTW) at the applicable rate (typically 9% for food). Delivery charges and any other administrative costs are listed separately during the checkout process before the purchase is finalized.
Article 4 – Offer
Our offer is valid while supplies last and is subject to change. While we strive for absolute accuracy, images are for illustrative purposes; the physical packaging or garnishing may vary. Proper Plates is not liable for obvious material, typographical, or printing errors in the offer.
Article 5 – Conclusion of Purchase
A purchase agreement is concluded once the Customer completes the order process on the Website and full payment is received via the indicated payment methods. Following payment, the Customer will receive a confirmation email with the purchase details and delivery terms.
The Seller reserves the right to refuse or cancel orders if:
An item is out of stock or no longer available.
A clear pricing error was present in the offer.
The delivery address is outside the Netherlands.
Force majeure events prevent fulfillment.
Article 6 – Delivery
Proper Plates uses specialized cold-chain logistics partners (e.g., PostNL Food or equivalent) to ensure meals remain at -18°C during transit.
6.1 – Responsibilities & Rates Proper Plates will make every effort to deliver products to the address provided by the Customer within the specified window.
Seller/Carrier Error: If a package arrives later than indicated due to our error and is no longer frozen, the Buyer may choose a full refund or a replacement delivery.
Buyer Error: If the Buyer is not present during the specified delivery window or provided incorrect address data, Proper Plates is not responsible for the resulting loss of quality, defrosting, or shelf life.
PO Boxes: We cannot deliver frozen goods to PO Boxes.
6.2 – Delivery Times Indicated delivery times are estimates. While we strive for punctuality, failure to meet an indicative time does not automatically entitle the Buyer to compensation. Non-delivery must be reported in writing within 45 calendar days of the order confirmation; otherwise, the order is considered accepted.
Article 7 – Complaints
Any visible damage, quality defects, or discrepancies in the delivery must be reported to sayhello@eatproperplates.com immediately (and no later than two months after delivery). We aim to respond to and resolve all complaints within 7 days.
Article 8 – Warranty
The statutory warranty applies to all items. For our perishable frozen meals, the warranty is limited to the "Best Before" (THT) date indicated on the packaging, provided the product has been stored continuously at -18°C or colder.
Article 9 – Right of Withdrawal (Important)
Under Article 6:230p of the Dutch Civil Code (Burgerlijk Wetboek), the legal right of withdrawal (the "cooling-off period") does not apply to:
Products that spoil quickly or have a limited shelf life (including our frozen meals).
Sealed products which are not suitable for return for reasons of health protection or hygiene once the seal/packaging has been broken after delivery.
Article 10 – Liability
Proper Plates warrants that products comply with the agreement and reasonable requirements of soundness and food safety. Our liability for any damage (direct or indirect) caused by delivered products is limited to the value of the order, except in cases of mandatory legal provisions or gross negligence.
